Terms and Conditions

Applicability of Terms:

These Terms and Conditions, in so far as they refer to the User, form the contract and agreement between the User and iBikx Insurance Solution ( IIS) unconditionally. Please review the following rules (“Terms of Use”) that govern the User’s use of our Site as they constitute a legally binding agreement between the User and IIS. Please note that use of our Site constitutes acceptance of these Terms of Use and agreement to be bound by them.

In these Terms of Use, references to ‘iBikx Insurance Solution ( IIS) ‘we’, ‘us’ and ‘our’ are references to IIS. We may change, move or delete portions of, or may add to, these Terms of Use from time to time. Continued Use of the website by the User following any such change constitutes agreement to follow and be bound by the rules as changed by the User.

The terms of this policy shall supersede all prior discussions, agreements and negotiations between the parties as to the subject matter hereof.

We from IIS wants you to register and provide your personal information that identifies you, including your content preferences, for three primary purposes (full details of IIS’s use of your personal data can be found in our Privacy and Cookies Notice):

To allow you to personalize IIS websites you are visiting to show content, text, video, audio, images etc. (“Content”) according to your interests.
To enable features such as password reminder, news alerts, email a colleague, and linking from IIS (and its affiliate sites) to your website/App.
To produce your feedback for our content providers, speakers, partners, or advertisers (“Contributors”) who contribute Content available in the Website/App.

Right to alter the Services:

Website/App facility is being offered at the sole discretion of IIS and IIS reserves the right to add, amend, revise, withdraw, suspend or cancel the usage of this viewable/usable rights of the Website/App either in whole or in part any of the services which are part of the Website/Apps facility, without any prior notice to the User. Any addition, amendment, revision, suspension or cancellation shall be effective and binding on the User. IIS may introduce new services (forming part of Website /Apps facility) on the Website/Apps from time to time. The existence and availability of the new services as part of the Website/App facility will be notified on the Website as and when they become available.

You may not modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, link, display, or in any way exploit any of the Content, in whole or in part, except as expressly permitted in these Terms or with the prior written consent of IIS. You may not use electronic or other means to extract details or information from the Content. Nor shall you extract information about users or Contributors in order to offer them any services or products.

Terms of usage of the Website/App:

As a condition of accessing the Website/App and usage of the Website/App facility, the User unconditionally and absolutely acknowledges and accepts the Terms and Conditions in its entirety.

User further acknowledges that the availability of the information, advice and the guidance, if any, on the Website/App does not constitute a recommendation (unless indicated otherwise) and is not a solicitation (unless indicated otherwise) by IIS or any of their personnel or the experts used by IIS.

User acknowledges that the decision to select any of the courses/trainings/Cards/videos offered by IIS is solely at his/her discretion and he/she has not been directed or forced to select any courses by IIS or its employees.

Correctness of Content –

IIS does not hold any responsibility of the correctness and meaning of the Content provided by the Contributors.

Compliance with Cyber Security:

User warrant that he/she will not:

Participate in any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or IIS’s systems or networks, or any systems or networks connected to the Site or to IIS.
Use any device, software or routine to interfere or attempt to interfere with the proper working of the Site or any transaction being conducted on the Site, or with any other person’s use of the Site.
Attempt to probe, scan or test the vulnerability of the Site or any network connected to the Site, nor to breach the security or authentication measures on the Site or any network connected to the Site.
Attempt to reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other customer of IIS, including any IIS account not owned by you, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Site.
Attempt to reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other customer of IIS, including any IIS account not owned by you, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Site.
Use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the website or any content, or in any way reproduce or circumvent the navigational structure or presentation of the website or any content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the website.
Attempt to gain unauthorized access to any portion or feature of the website, or any other systems or networks connected to the website or to any IIS server, or to any of the services offered on or through the website, by hacking, password “mining” or any other illegitimate means.
Attempt to forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmittal you send to IIS on or through the website or any service offered on or through the website. You may not pretend that you are, or that you represent, someone else, or impersonate any other individual or entity.
Attempt to use the website or any content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of IIS or others.
Attempt to introduce or cause to introduce any computer contaminant and by means of such conduct cause or be likely to cause damage or destruction to IIS’s property or disruption of IIS’s services.
Attempt to knowingly or intentionally penetrate or access IIS network or systems without authorization or exceeding authorized access; and by means of such conduct carry out an unauthorized transaction or obtain access to information, data or computer database that is restricted.

Viruses and Malicious codes

User shall pursue all necessary steps to ensure that their machines are virus free while accessing IIS Website. User shall refrain from activities like uploading files infected with viruses or malicious scripts/ programs or trying to infect the IIS system with viruses, worms & other malicious codes.

Unethical practices

User warrants that the User will not use any software, tool or code that would hamper or disable all or any portion of the portals or Services offered by IIS. User also warrants against use of reverse engineering tools to break or harm the portals or services offered by IIS.

Individual Registration, Access and Exchange of Information

For certain services such as email, personal web pages, Content and Content shopping, registration by the visitor is required. To register for these services you have to open an account by completing the registration process (i.e. by providing us with current, complete and accurate information as prompted by the applicable registration form). You also will choose a password and a username. You are entirely responsible for maintaining the confidentiality of your password and account. By registering, you agree to the following terms in addition to any other specific terms which shall be posted at an appropriate location of the Website. Each registration is for a single individual user only.

To access these services, you will be asked to enter your individual username and password, as chosen by you during your registration. Therefore, we do not permit any of the following:- Any other person sharing your account and password; Any part of the Website being cached in proxy servers and accessed by individuals who have not registered with IIS as users of the Website/App; or access through a single account and password being made available to multiple users on a network.

If IIS reasonably believe that an account and Password is being used / misused in any manner, IIS shall reserve the right to cancel access rights immediately without notice, and block access to all users from that IP address.

Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify IIS immediately of any unauthorized use of your account or any other breach of security. IIS will not be liable for any loss that you may incur as a result of someone else using your password or account. However, you could be held liable for losses incurred by IIS or another party due to someone else using your account or password.

Terms of Usage of the Website with specific reference to the Users in connection with their selected products:

Registration Obligations:

As a pre-requisite for accessing the content on the Website, IIS may require you to register for availing the services. You are requested to complete all the required columns and IIS retains the right to cross-verify the same by requesting you to provide documentary evidence for the same. IIS also reserves the right to terminate the registration in its own discretion, not limited to submIISion of erroneous / incomplete / derogatory / inappropriate / incomplete information. IIS shall at no times be required to ensure that the details provided by you are up to date and it shall be the duty for each User that the same is duly updated at all points of time.

User ID and User Password:

User acknowledges that he/she would be able to access the Website/App facility with regard to his/her selected product by using the User ID and the User Password. User further confirms and agrees that he/she will be the sole and exclusive owner and is the only authorised user of his/her User ID and the User Password and accepts sole responsibility for use, confidentiality and protection of the User ID and the User Password as well as for all account transactions initiated through his/her User Account and shall ensure that the User password/s is/are not revealed to any third party or recorded in any written or electronic form. In case the User forgets or loses his/her the User ID or the Password, the User would be able to retrieve his/her User ID or Password by following the procedure on the Website. User undertakes not to disclose the User Password to any person including employees of IIS. IIS will be entitled to levy service charges for generation of new password.

Account Transactions:

User shall at all times be fully responsible and liable for all account transactions that are carried out by the use of the User ID or the User Password registered under the User (“Account Transactions”). If third parties gain access to the services offered as part of the Website/App facility through the use of the User ID and User Password, the User shall be deemed to be responsible and the User hereby indemnifies and holds IIS harmless against any liability, costs or damages arising out of claims or suits by or against such third parties based upon or relating to such access and use.

Any Account Transactions authorised by using the User ID and User Password shall be deemed to be that of and initiated by the User and IIS shall treat the transactions as genuine and will carry them out even if given in error, and is not responsible for any mistake / error made by the User in keying in any details or data or any facts or figures. IIS will endeavour to carry out the instructions correctly, but it is the User’s responsibility to check that IIS has carried out instructions correctly. If the transaction has not been carried out correctly or an error has occurred, the User should notify IIS as soon as possible.

IIS would be entitled, at its sole discretion, to seek offline written or other confirmation from the User of any Account Transaction as it may deem fit to ascertain or verify the genuineness of request for Website/App facility.

Unauthorised access:

Users are instructed to use legitimate User ID and Password assigned to them only. Use of access credentials meant for other users will be identified as unauthorised access to the Website and the User may be disabled or barred from using other services. Legal action may be taken as per applicable law. The Site and/or the services may be temporarily unavailable or restricted for administrative or other reasons. If this happens, IISwill endeavour to restore their availability as quickly as possible.

Evidence of Account Transactions:

IIS own records of the Account Transactions maintained through computer systems or otherwise including time of the Account Transactions shall be conclusive proof of the genuineness and accuracy of the Account Transactions and binding for all purposes.

Restrictions on Use:

User agree to use the Website/App strictly for his/her personal use. User agree not to use this Website or the Website facility for any purpose which is manner inconsistent with these Terms and Conditions or in contravenes any provisions of law or is deemed inappropriate by IIS. User agree not to use, transfer, distribute or dispose of any information contained in the Website in any manner that could compete or conflict with the business interest of IIS or otherwise compromise or imperil the interests of IIS.

Material Posted/transmitted at IIS’s Site

All information, data, text, software, music, sound, photographs, graphics, video, messages, case studies, reports, whitepapers or other materials (“Content”), whether publicly or privately transmitted / posted, is the sole responsibility of the person from where such content is originated (the Originator). By Posting any material which contain images, photographs, pictures or that are otherwise graphical in whole or in part (“Images”), Contributor warrant and represent that (a) Contributor is the copyright owner of such Images, or that the copyright owner of such Images has granted the Contributor permIISion to use such Images or any content and/or images contained in such images consistent with the manner and purpose of its use and as otherwise permitted by these Terms of Use and the Services, (b) Contributor has the rights necessary to grant the licenses and sublicenses described in these Terms of Use, and (c) that each person depicted in such Images, if any, has provided consent to the use of the Images as set forth in these Terms of Use, including, by way of limitation, the distribution, public display and reproduction of such Images.

Contributor represent that it has the valid rights and title in any and all Content/Images that is submitted by the Contributor on the Website, that Contributor did not infringed on any IPR belonging to any party and further that Contributor will indemnify IIS or its affiliates for all claims arising out of any Content that is posted by the Contributor on the Website/App.

Posting/uploading of any information or material, which is harmful, defamatory, obscene, pornographic, libelous, invasive of another’s privacy, profane, hateful, or racially, ethnically objectionable, disparaging, or otherwise unlawful in any manner is prohibited and any person found to be involved in such activity on this website/app will solely be liable for actions under the applicable laws.

IIS accepts no responsibility for the said Content / Images. However, the Contributor understand that all Content / Images posted by the Contributor and the Contributor agree to grant/assign to IIS and its affiliates, a non-exclusive, royalty free, perpetual, irrevocable and sub-licenseable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content/Images (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed throughout the world”.

Exchange of Information, commenting and chatting & other Community Services

Contributor represent that Contributor being a responsible adult (18 years or above) and it shall be solely responsible for all Content that Contributor upload post or otherwise transmit.

IIS endeavours to provide a web platform for various community interactions for persons to interact and exchange views with each other. The Content posted on such services is by general public therefore the accuracy, integrity or quality of such Content cannot be guaranteed. Contributor understand that by using such services, Contributor may be exposed to objectionable matter.

By using the facility of commenting & chatting and other community services Contributor agree not to upload, post, or otherwise transmit any matter or views, which are, defamatory, abusive, pervasive, obscene, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable. Contributor may also not indulge in cyber stalking, become or create a nuisance for any visitor / user of the Website/App.

Contributor may not send, submit, post, or otherwise transmit, material or messages that contain software virus, or any other files that are designed to interrupt, destroy, and negatively affect in any manner whatsoever, any electronic equipment in connection with the use of this Websiite/App, or other user’s ability to engage in real time exchanges.

Prohibited Activities

Contributor shall not host, display, upload, modify, publish, transmit, update or share any information on the Website, that —

Belongs to another person and to which Contributor does not have any right to;
Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;
Harm minors in any way;
Infringes any patent, trademark, copyright or other proprietary rights;
Violates any law for the time being in force;
Deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
Impersonate another person
Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commIISion of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

Any Content uploaded by Contributor shall be subject to relevant laws and may disabled, or and may be subject to investigation under appropriate laws. Furthermore, if you are found to be in non-compliance with the laws and regulations, these terms, or the privacy policy of the Website, we may terminate your account/block your access to the Website and we reserve the right to remove any non-compliant Content uploaded by Contributor.

Any Content and or comment uploaded by Contributor, shall be subject to relevant Indian laws and may be disabled, or and may be subject to investigation under appropriate laws. Furthermore, if Contributor is found to be in non-compliance with the laws and regulations, these terms, or the privacy policy of the Website/App, IIS shall have the right to immediately terminate/block your access and usage of the Website/App and IIS shall have the right to immediately remove any non-compliant Content and or comment, uploaded by Contributor and shall further have the right to take recourse to such remedies as would be available to the IIS under the applicable laws.

Payment instruction:

When IIS receives a transaction instruction from the User through online payment mode, we will be entitled to debit any payment plus any charges payable for the transaction from the account the User have specified. We shall not be liable if any transaction does not fructify or may not be completed or for any failure on part of the bank or the credit card agency to perform any of its obligations. We shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any transaction. IIS reserves the right to charge subscription and / or membership fees from a user, by giving reasonable prior notice, in respect of any product, service or any other aspect of this Website/App.

10.Foreign Jurisdiction:

IIS accepts no liability whatsoever, direct or indirect for non-compliance with the laws of any country other than India. The mere fact that the Website/App can be accessed by a User in or from a country other than India would not mean that the laws of the said country would govern these Terms and/or the use of the Website/App by the User. IIS’s performance of Terms and Condition is subject to existing laws and legal process, and nothing contained in this Terms and Conditions is in derogation of IIS’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of Website/App or information provided to/ gathered by IIS with respect of such use.

Intellectual Property Rights:

Unless expressly stated otherwise, all material images, illustrations, designs, icons, photographs, music, video clips, audio material, text, trademarks or logos, directories, charts, guides, excerpts, opinions, critiques reviews, made available through this website (collectively, the “Content”) are protected by copyrights, trademarks and/or other intellectual property rights owned, controlled or licensed to IIS and/or its subsidiaries, affiliates and advertisers. The User should assume that everything he/she, see or read or hear or experience on the Website/App is copyrighted / protected by intellectual property rights laws unless otherwise mentioned and may not be used except as provided in these Terms and Conditions.

Contributors own the copyright and are solely responsible for the Content provided by them, to publish on the website and will indemnify IIS for any and all losses, claims, liabilities arising due to infringement of any 3^rd party intellectual property rights.

Downloads:

Please note that any downloads provided may only be used for promotional, marketing programmes and/or awareness building purposes relating to IIS and for no other purpose. All software, multimedia files, photographs, reports and other documents are downloaded at your own risk. We do not warrant the suitability of any such downloads and accept no liability for any problems with your computer that may arise as a result. If you are in any doubt as to the suitability of any such downloads for your computer, it is recommended that you obtain specialist advice before downloading.

Miscellaneous:

IIS may sub-contract and employ advisors to carry out any of its obligations under these Terms and Conditions. IIS may transfer or assign its rights and obligations under this contract to any Affiliate.
All Account Transactions, which cannot be carried out instantaneously, would be carried out during working hours either on the same day or such further period as may be determined and/or specified by IIS depending upon the time of logging of the transaction / nature of transaction. The User is requested to check with IIS the estimated time required for completion of transaction / request, prior to execution of a transaction / request.
The performance of our obligations under these Terms may be interrupted and shall be excused by the occurrence of a force majeure event affecting us or any of our sub-contractors.
All Account Transactions shall be subject to Government notifications, the rules, regulations and guidelines IISued by the Reserve Bank of India, and those of other regulatory bodies defining rules/regulations governing the offer of any service under the Website facility, if any, on which such transactions are executed and/or cleared by IIS.
IIS also uses third party services for commercial transactions and payments. The security and privacy of those sites are not managed by IIS, however IIS shall be indemnified for any fraudulent transactions or misuse.
If IIS fails to exercise any right or remedy under these terms, this shall not prevent IIS from doing so at any time in the future.
The words ‘including’ or ‘include’ and words of similar effect will not be deemed to limit the general effect of the words which follow them.
Each provision of these terms will be construed separately and, in the event that any such provision may prove to be illegal or unenforceable, the remaining provision of these terms will continue in full force and effect.
The headings to sections will not form part of these terms and will not affect the interpretation of any section.
Any disclaimers and exclusions contained within these terms will survive termination of these terms.

Disclaimer:

User agree to indemnify and keep IIS indemnified at all times from all losses, damages, costs, expenses, loss of profits, loss of business, proceedings, actions, suits (including legal fees) caused to or suffered by IIS as a direct or indirect consequence of the User actions, including due to breach of Terms due to negligence or default.

We make no warranty regarding the Account Transactions entered into through the Website/App. No advice or information, whether oral or written, obtained by the User from or through the Website/App facility or any person shall create any warranty not expressly stated herein.

The Content is general information only. It is to be noted that the Content provided in the website does not constitute any kind of advice/knowledge and it is not intended to address your specific concerns/requirements and no reliance should be placed on such Content. IIS and its Contributors and other suppliers make no representations and warranties about the provided information contained in the Content for any purpose. All Content provided “as is” without any kind of warranty. IIS and its Contributors and other suppliers hereby exclude and disclaim all representations, warranties or guarantees with regard to the Content, information, uploaded video including all implied warranties and conditions of merchantability, views expressed, fitness for a particular purpose, title and non-infringement. To the maximum extent permitted by law, IIS expressly excludes all representations, warranties, obligations, and liabilities arising out of or in connection with all Content. In no event shall IIS and its Contributors and suppliers be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, data or profits, whether in an action of contract, negligence or other tortious action, arising out of or in connection with the use of the Content or performance of IIS’s Services.

IIS, its employees and directors, its suppliers and its third-party advisors shall not be liable for any action taken by the User based on or relying on the information provided in or by the Website/App.

We will not be liable for any direct, incidental or consequential loss, which may be caused to the User as a result of his/her use of the Website / App facility.

If the User is dIISatisfied with the Website/App or any portion thereof, the Website/App facility or with any of these Terms and Conditions, sole and exclusive remedy is to discontinue using this Website/App and availing Website/App facility.

User acknowledge that any rights not expressly granted herein are reserved.

Jurisdiction:

Usage of this Website/App and these terms and conditions shall always be governed by the laws of India and all disputes shall be subject to exclusive jurisdiction of courts at Mumbai.
